The Hon’ble High Court of Judicature at Bombay granted bail on 05.05.2020 to Zafar Jamal Khan, who obstructed a team constituted for collecting the data in light of COVID-19 pandemic. He was charged with offences under section 188,269 and 353 of Indian Penal Code, 1860 read with section 51(B) of the Disaster Management Act, 2005. The Nyay Nagar Police Station officials reported that at the time data collecting team visited the society, the accused was present in the society premises and he created an obstruction and persuaded the society members to not share any information, alleging that the information would be misused by the agency and also engaged in heated argument with the official authorities.

Hon’ble Justice Bharati Dangre while hearing the bail application observed that the act of the Applicant constitutes and irresponsible behaviour in the critical time where all the citizens of India are expected to cooperate with authorities in combating the spread of COVID-19 and directed him to deposit Rupees 10,000/- (Ten Thousand Only) in CM Relief Fund after the release and any failure to deposit the amount would entail him to face consequences. Further, Hon’ble Justice directed that the receipt of deposit should be placed on record within four weeks from 05.05.2020 and also directed the Public Prosecutor to communicate the abovementioned order to the concerned authority.
