The Ministry of Social Justice and Empowerment on 21.08.2020 published in the Gazette of India informing about the constitution of a National Council for Transgender Persons.

The said Council is constituted by the powers conferred upon the Central Government under Section 16 of the Transgender Persons (Protection of Rights) Act, 2019.

The Council for Transgender Persons thus formed would comprise of the Union Minister, Ministry of Social Justice and Empowerment- Chairperson, Minister of State, Ministry of Social Justice and Empowerment- Vice-Chairperson, Ex- officio members, the nominated members and the Joint Secretary to the Government of India in the Ministry of Social Justice and Empowerment dealing with the welfare of the transgender persons.

The Council shall perform the following functions as entrusted to it under Section 17 of the Transgender Persons (Protection of Rights) Act, 2019:

  1. Advise the Central Government on the formulation of policies, programmes, legislation and projects with respect to transgender persons;
  2. Monitor and evaluate the impact of policies and programmes designed for achieving equality and full participation of transgender persons;
  3. Review and coordinate the activities of all the departments of Government and other Governmental and non-Governmental Organisations which are dealing with matters relating to transgender persons;
  4. Redress the grievances of transgender persons; and
  5. Perform such other functions as may be prescribed by the Central Government.

The Centre on 13.07.2020 had published the draft ‘Transgender Persons (Protection of Rights) Rules, 2020’ which it proposed to notify under the Transgender Persons (Protection of Rights) Act, 2019.

It had also invited suggestions and objections, if any, from the stakeholders on the draft Rules.
