The Ministry of Corporate Affairs has released a list wherein extending the days for compliance of name reserved and resubmission of forms required under the Companies Act 2013. These are as follows:

  1. Names reserved for 20 days:

The names reserved for 20 days for new company incorporation, compliance of SPICe and Part B needs to be filed within 20 days of name reservation is required. Now, names expiring any day between 15.03.2020 – 03.05.2020, is extended by 20 days from 03.05.2020.

  1. Name reserved for 60 days:

The names reserved for 60 days for change of name of company requires compliance of INC-24 to be filed within 60 days of name reservation. The names expiring any day between 15.03.2020 – 03.05.2020, now gets extension of 20 days from 03.05.2020.

  1. Extension of RSUB validity for companies:

The service request number (SRN) wherein the last date of Resubmission (RSUB) falls between 15.03.2020- 03.04.2020, an extension of 15 days from the date of 03.04.2020 is being allowed. For SRNs already marked under NTBR the extension would vary upon case to case.

The forms will not get marked to (not to be taken on record (NTBR)) due to non-resubmission during the extended period provided abovementioned.

  1. Name reserved for 90 days for new LLP:

The name reserved for 90 days for incorporation of new LLP or change of name compliance of FiLLiP/Form 5 required to be filled within 90 days from the date of name reservation. Now, the names expiring on any day between 15.03.2020 – 03.05.2020 are given an extension of 20 days from 03.05.2020.

  1. RSUB validity extension for LLPs:

The service request number (SRNs) wherein the last date of resubmission (RSUB) falling between 15.03.2020 – 03.05.2020, extension of 15 days is provided from 03.05.2020. The SRNs marked under NTBR extension would be provided depending upon case to case.

The forms will not get marked to (not to be taken on record (NTBR)) due to non-resubmission during the extended period provided abovementioned.

The abovementioned extended period for compliance of reserved names and resubmission is the relaxation provided by the Ministry in view of the difficulties faced by the stakeholders in the lockdown amid COVID-19.
