The primary focus of major new channels is on the frenzied issue of the Karnataka Governor making way for the BJP to form the government in Karnataka with the Congress and JD(S) objecting to the invitation stating lack of majority of the BJP. With several political critics and debates discussing upon the constitutional power of the Governor in exercising his duties, a very eminent and celebrated lawyer of India decided to challenge the Governor’s decision by way of his Constitutional powers.

Shortly after the Supreme Court refused to stay the oath taking ceremony of BS Yedyurappa as the Karnataka CM, Senior Advocate Ram Jethmalani moved the Supreme Court in his personal capacity challenging the Karnataka Governor Vajubhai Vala’s decision to invite the BJP for forming the Government in Karnataka. A bench comprising of Chief Justice of India Dipak Misra, Justice A.M Khanwilkar and Justice D.Y Chandrachud directed Mr. Jethmalani to make submissions pertaining to his petition before the three judge bench that heard the matter in the wee hours of Thursday i.e. 17th May 2018. Thus, Mr. Jethmalani’s petition would be heard by the bench comprising of Justice A.K Sikri, Justice S.A Bobde and Justice Ashok Bhushan who had presided over the petitions filed by the Congress and Janata Dal (Secular) and had rejected the prayer for cancellation of the oath taking ceremony. The brief of the petition filed by the Congress and JD(S) and the basis of challenge can be referred to here.
