Amidst the COVID-19 pandemic and the subsequent nationwide lockdown has resulted in a huge economic setback for the country. Economic condition of several professional sectors has gone for a toss resulting in the unemployment of over 122 million Indians alone in the month of May as per the Centre for Monitoring Indian Economy (CMIE).
Considering the grim situation of lawyers due to the same, Telangana Government decided to provide financial assistance to all Advocates and Advocate Clerks’ in need. The said announcement was made vide press release dated 28.05.2020.
According to the press release, Telangana Government decided to sanction an amount of Rs. 25,00,00,000/ – (Rupees Twenty-Five Crores Only) to the law department after which an amount of Rs. 15,00,00,000/- (Rupees Fifteen Crores Only) was immediately released for the same.
As per the press release, a number of guidelines were formulated by a committee formed by the Telangana Advocates’ Welfare Trust under the guidance of the Hon’ble Chief Justice, Raghvendra Singh Chauhan. Therefore, as per the guidelines, advocates who are eligible to claim the financial assistance are as follows:
- should be in real and active legal practice at the Bar;
- must have passed the All India Bar Examination;
- must not be earning more than Rs. 15,000/ (Rupees Fifteen Thousand Only/-) per month;
- Should not be receiving any monthly payment from the Advocate’s Office, where he/she’s been working as a Junior Advocate;
- Spouse should not be a government/private employee;
Anyone who has retired from legal services but is still enrolled as an advocate will not be eligible for the said financial assistance.
On the advice of the Hon’ble Chief Justice, the committee resolved to grant Rs. 10,000/ (Rupees Ten Thousand Only) to each advocate and amount of Rs 5,000/- (Rupees Five Thousand Only) to each advocate clerk eligible for the same.
Furthermore, the Telangana Government also laid down the procedure, following which an advocate in need may apply for financial assistance. As per the procedure laid down, advocates in need may send applications to the respective bar associations via WhatsApp or email after which their applications would be scrutinised and subsequently approved by the President/Secretary and Judicial Officer. The advocate would then have to forward the same to the Telangana Advocates’ Welfare Trust via email.
In case of advocate clerks’, the eligibility criteria to receive financial assistance are as follows:
- Submit a copy of Certificate of Registration as a clerk;
- Should not have been earning more than Rs. 10,000/ (Rupees Ten Thousand Only) per month;
- Spouse shouldn’t be a government/private employee.
The press release also stated that the Trust had received 14,166 applications from advocates and a total of 1029 applications from advocate clerks’.
The financial assistance was released on 28.05.2020 to all the needy advocates and advocate clerks via online payment by Hon’ble Chief Justice Raghvendra Singh Chauhan.
